Our website policies are designed with you, the customer, in mind to ensure that your online shopping experience with Belle Divine will be secure, prompt, efficient and hassle-free.

The E-Commerce online purchase service is provided to you subject to the following Terms and Conditions. If you visit or shop at belledivine.co.nz you accept those terms and conditions.

Please read them carefully.

You must be aged 18 years or over to use this service. Completing an online order is a declaration to us that you are aged 18 years or over.

 

ONLINE SHOPPING TERMS & CONDITIONS

This Terms and Conditions document governs the use of belle divine's Online Service (the Service). You can access this Agreement at any time from the bottom of any page of the site.

belle divine is committed to the New Zealand Model Code for Consumer Protection in Electronic Commerce.

PRICING

All prices in the shopping areas are in New Zealand dollars (NZ$) and include GST where required. All prices are correct at time of publication, however we reserve the right to alter prices for any reason. If this should happen after you have ordered a product, we will contact you prior to processing your order.

Delivery charges are calculated and added to your order after you enter your delivery location and before you enter your credit card details. You get to see the full charge before completing your purchase.

You agree that, because of the nature of world wide Internet sales, the online purchase facility is provided by us on an ‘as is’ and ‘as available’ basis

We are not liable to you if we are unable to supply a particular item, or if any delay in supply is experienced. Items supplied for delivery outside New Zealand may be subject to local taxes and levies on delivery. These charges are the responsibility of the purchaser and do not constitute any part of the price charged by Belle Divine

Payment details may be completed online utilising any of the listed credit cards.

Your payment will not be charged to your account until the items you have ordered are ready for dispatch, in part or full completion of your order.

Title to all goods shall remain with Belle Divine until full and final payment has been made.

 

ONLINE SECURITY

Data encryption software minimizes the risk of interception of any information you provide online.

When you place an order this data passes to a secure server. All information you input is encrypted before it is sent to us.

Any data sent by you through this site is encrypted through a Secure Sockets Layer (SSL) connection. SSL is a protocol developed for transmitting data over the Internet.

What this means is that your data (including credit card information and other personal details) is turned into a type of code that cannot be decoded without the private key.

Whenever you go to your shopping cart or start to complete a purchase, you will automatically be transferred to the secure area of Belle Divine Online. You can always tell if you are in this area as the start of the website address at the top of your screen will have changed from “http://...” to “https://...”

With most Internet browser software (including all recent versions of Internet Explorer and Netscape), a locked padlock icon also appears in the bottom toolbar of the browser, signaling that you are currently in a secure area of the site.

DELIVERY

In New Zealand we will deliver using either DX Mail , NZ Post Parcel Post or FastwayCouriers.

Couriers may require a signature upon delivery. If no one is home, the courier will leave a card requesting that you contact the Courier office to arrange a suitable delivery time.

Delivery to Post Office Boxes is by NZ Post only.

Goods are deemed to have been delivered once the Proof of Delivery scan has been completed

Please Note: All goods are insured up until the point of delivery. Delivery will generally be deemed to have occurred once a signature is obtained, or wherever the goods are left as per your special delivery instructions, or when the delivery agent has performed a proof of delivery scan.

International orders are only accepted for countries within our distribution area. Delivery is made by New Zealand Post International Airmail and subject to its normal terms and conditions. Delivery will take approximately 4-10 working days depending on destination. Items supplied for delivery outside New Zealand may be subject to local taxes and levies on delivery. These charges are the responsibility of the purchaser and do not constitute any part of the price charged by belle divine.

The anticipated delivery time for New Zealand orders will be within 5 working days (we will be away from 9-15th Feb 2010 so all orders placed during this time will be processed on 16th Feb) unless an item ordered is out of stock in which case you will be notified of the expected additional delay within the usual expected delivery time.

On occasion not all items ordered will be available in stock. If after 2–3 working days the full order has not been sourced we will, at our discretion, deliver some goods now and the rest when they arrive.

GUARANTEE & RETURNS

Your rights under the Consumers Guarantees Act 1993 protect you. Please note however that the Consumers Guarantees Act does not cover the purchase of any goods for business purposes (excluding home office use).

belle divine is committed to providing quality products to our customers. With the exception of jewellery and Fashion First Aid items if for any reason you are not completely satisfied with any product, please return it to us in original condition within 14 days of receipt and we will replace it or refund your purchase price using the original payment method.

To return products to belle divine, please affix postage to your package and send it to the P O Box address. Unfortunately, your postage charges on returns are not refundable. However, if you are returning an item for exchange (i.e. the same style is being changed for a different size or colour), you are not required to pay for standard delivery on the outgoing replacement parcel.

Jewellery items may not be returned unless faulty. Fashion First Aid Products may only be returned if unopened and unused. Please choose carefully.

COPYRIGHT

IRRESPECTIVE OF WHETHER TITLE TO ANY PRODUCTS PASSES TO YOU ("THE CUSTOMER") THE COPYRIGHT AND ANY OTHER INTELLECTUAL PROPERTY RIGHTS IN, ON OR ASSOCIATED WITH THE PRODUCTS INCLUDING WITHOUT LIMITATION TRADE MARKS AND DESIGN RIGHTS ("INTELLECTUAL PROPERTY"), SHALL AT ALL TIMES REMAIN VESTED IN THE BELLE DIVINE OR ITS LICENSORS AND NO SUCH RIGHTS SHALL PASS TO THE CUSTOMER.

You ("The Customer") shall not and shall not permit a third party to:
a) copy the whole or any part of the Products;
b) supply the Products to any individual or organisation for resale
c) copy and distribute to the public any of the Products;
d) adapt the Products and do any of the things listed above.

EMAIL POLICY

We only email you if you want us to. We do not send unsolicited emails. When you register your email address with us you go on a list to receive email announcements about products, offers and promotions from Belle Divine. We do not disclose your email address to third parties.

Every email message we send includes an email address to which you can respond. If at any time you decide you do not want to receive our emails, simply reply with the word “Unsubscribe” This will remove your email address from our mailing list. If you unsubscribe you will still receive emails specifically related to your online orders.
